Welcome to tjantek.store, operated by Tjantek, a trading brand of Jehovah-Raah Pty Ltd (ABN 70 658 254 329). By continuing to browse and use this website you are agreeing to comply with and be bound by these terms and conditions, which together with our Privacy Policy and Website Disclaimer govern your use of this website.

For the purposes of these terms, "Tjantek", "Us", "Our", and "We" refers to Tjantek as the trading brand of Jehovah-Raah Pty Ltd (ABN 70 658 254 329), and "You" and "Your" refers to you, the visitor, customer, or person using this website.

Amendment of terms
We reserve the right to change, modify, add, or remove portions of these terms at any time. For changes that materially affect your rights or obligations, we will endeavour to provide reasonable advance notice, which may be given by publication on this website, by email to your registered address, or by notice at the point of next purchase or login. For minor or operational changes, the updated terms will be published on this website with a revised 'last updated' date, and your continued use of this website following any such change constitutes your acceptance of the updated terms. Where a material change would adversely affect an existing transaction already in progress, that change will not apply to that transaction.

Limitation of liability
It is an essential precondition to your use of this website that you agree and accept that Tjantek is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or omissions in our documents or information, any goods or services we may offer, or from any other use of the website. Your use of or reliance on any information or materials on this website is entirely at your own risk. It shall be your own responsibility to ensure that any products, services, or information available through this website meet your specific requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law. To the maximum extent permitted by applicable law, Tjantek’s total aggregate liability to you for any claim arising out of or in connection with an advisory engagement, digital product purchase, or use of this website is limited to the fees paid by you to Tjantek under the specific engagement or transaction giving rise to the claim. Tjantek is not liable for any indirect, incidental, special, consequential, economic, or financial loss arising from your reliance on any report, recommendation, framework, advisory output, or digital product, including any business decision made based on that output. Nothing in this clause limits liability that cannot be excluded under the Australian Consumer Law or other applicable mandatory law. To the maximum extent permitted by applicable law, the total aggregate liability of Jehovah-Raah Pty Ltd across all of its trading brands arising out of or in connection with your use of any of its websites or services shall not exceed the amount you paid to Tjantek in connection with the specific transaction or engagement giving rise to the claim.

Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded, modified, or restricted under the Australian Consumer Law and are in addition to any other warranty. Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. For the purposes of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), our liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again. You must be over 18 years of age to use this website and to purchase any goods or services.

Delivery of goods
Tjantek products are made to order and fulfilled by our third-party fulfilment partner. Deliveries are processed promptly upon receipt of full payment. We currently ship to Australia and the United States. Shipping destinations and applicable rates are displayed at checkout and are subject to change. The destinations and rates displayed at checkout at the time of your order are binding for that order. Estimated delivery timeframes are provided as a guide only and are not guaranteed. We are not liable for delays caused by carriers, customs processing, or circumstances outside our reasonable control. Tjantek is not responsible for goods that are damaged or lost in transit. Claims for lost, damaged, or undelivered orders must be raised with us within 30 days of the estimated delivery date. We will liaise with our fulfilment partner on your behalf. Resolution is subject to carrier investigation and is not guaranteed where delivery is confirmed by tracking. Replacement of damaged or lost items is at our reasonable discretion and subject to your statutory rights under the Australian Consumer Law.

Returns and after-sales support
Tjantek products are made to order by our fulfilment partner. When your order is dispatched, you will receive a fulfilment confirmation email from our fulfilment partner containing a direct link to their customer support portal. That portal is the primary channel for raising any concerns about your order, including damaged goods, print quality issues, and delivery problems. Where you raise a concern through the portal, our fulfilment partner will assess and respond to your request directly. Tjantek is not the primary point of contact for after-sales matters that can be handled through the portal. Nothing in this clause limits your statutory rights under the Australian Consumer Law. Where a concern cannot be resolved through the portal, or where your statutory rights require a remedy from Tjantek directly, you may contact us at contact@tjantek.store. For customers located in the United States or Canada, your statutory rights under applicable consumer protection laws in your jurisdiction are not affected by this clause. The portal process is a convenience mechanism and does not substitute for any legally required remedy. Tjantek is not responsible for outcomes or decisions made through the fulfilment partner's support process. Our obligation is to ensure the portal link is made available to you, not to guarantee any particular outcome through it.

Product descriptions
We take reasonable steps to ensure that product descriptions, images, and specifications are accurate at the time of publication. Colours, textures, and finishes displayed on this website may vary from the physical product depending on your device screen settings, printing processes, and production batches. We do not warrant that product descriptions are entirely free from error.

Exclusion of competitors
If you are in the business of creating, distributing, or commercialising any product, service, framework, or material that competes with or substitutes for any product or service offered by Tjantek, whether directly or indirectly, then you are a competitor of Tjantek. Tjantek expressly excludes and does not permit you to use or access this website, to download any documents or information from it, or to obtain any such documents or information through a third party. If you breach this term, Tjantek will hold you fully responsible for any loss sustained and accountable for any profits made from such unpermitted use. Tjantek reserves the right to exclude and deny any person access to this website, services, or information in its sole discretion.

Privacy
Tjantek takes the privacy of your personal information seriously. We handle personal information responsibly and are working towards a data handling framework consistent with Australian Privacy Principles. Your rights regarding access to and correction of personal information we hold about you are set out in our Privacy Policy. Please read our separate Privacy Policy carefully. Credit card and payment information is not stored by us on our servers. All payment processing is handled by our payment provider through encrypted, secure channels.

No other term is to be included in this agreement except where required by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.

Severability
Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory, such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories.

Independence of trading brands
This website is operated by Tjantek, a trading brand of Jehovah-Raah Pty Ltd (ABN 70 658 254 329). Jehovah-Raah Pty Ltd operates multiple trading brands, each as a separate and independent business. A claim, dispute, liability, or obligation arising in connection with one trading brand does not extend to, bind, or create any liability against any other trading brand operated by Jehovah-Raah Pty Ltd. Your engagement with this trading brand does not create any rights against, or obligations on, any other trading brand operated by Jehovah-Raah Pty Ltd. Each trading brand operates under its own terms and conditions, privacy policy, and website disclaimer.

Assignment
You may not assign, transfer, or sub-license any of your rights or obligations under these terms to any third party without our prior written consent. Any purported assignment without our written consent is void. We may assign or transfer our rights and obligations under these terms in connection with a merger, acquisition, restructure, or sale of all or part of our business.

No waiver
No failure or delay by us in enforcing any provision of these terms constitutes a waiver of that provision or of any other provision. Our rights under these terms remain fully exercisable notwithstanding any prior failure to enforce them.

Engagement gates
Your engagement with Tjantek arises and concludes in defined stages. Each stage is a separate and distinct engagement. A new order opens a new engagement from Gate A regardless of any prior engagement.
Gate A: Your engagement opens at the moment a purchase transaction is completed at checkout. No engagement exists before this gate.
Gate B: Your purchase engagement closes upon confirmed delivery of your order to the delivery address provided at checkout. After Gate B closes, your remaining rights are limited to the returns and after-sales support process available through the link provided in your fulfilment confirmation email, and any statutory rights under the Australian Consumer Law.
Gate C: Your post-delivery engagement closes on the later of: (a) 30 days after confirmed delivery with no return or refund request raised; or (b) full resolution of any return or refund request raised within that window. After Gate C closes, this engagement is fully discharged. No obligation from this engagement continues after Gate C, subject only to any statutory right under the Australian Consumer Law that cannot be excluded or modified by agreement.
Nothing in this clause limits any right you have under the Australian Consumer Law that cannot be excluded or modified by agreement.

Survival of terms
The following clauses survive termination or expiry of these terms for any reason: Limitation of Liability, Intellectual Property, Dispute Resolution, Governing Law, Exclusion of Competitors, and Independence of Trading Brands. All other clauses cease to apply once your engagement with this trading brand has concluded, subject to the engagement gates above.

Dispute resolution
If a dispute arises in connection with these terms or any engagement with Tjantek, the parties agree to attempt resolution in good faith through direct negotiation within 30 days of written notice of the dispute. If unresolved, the dispute will be referred to mediation before a mediator agreed between the parties. If no mediator is agreed within 14 days, the mediator will be appointed by the ACT Law Society. Each party will bear its own costs of mediation, including legal representation costs, unless the mediator or a court of competent jurisdiction orders otherwise. Nothing in this clause prevents either party from seeking urgent injunctive or interlocutory relief. If litigation is required, the parties submit to the exclusive jurisdiction of the courts of the Australian Capital Territory.

Governing law and jurisdiction
These terms and this website are subject to the laws of the Australian Capital Territory and Australia. To the extent permitted by the laws applicable in your jurisdiction, Australian law governs your relationship with Tjantek. If there is a dispute between you and Tjantek that results in litigation, you must submit to the jurisdiction of the courts of the Australian Capital Territory.

Notice for customers outside Australia
Our website and services are operated from Australia. If you are located outside Australia, your personal information may be transferred to and processed in Australia and on the infrastructure of our third-party service providers, which may be located in other countries, including the United States. By using this website, you acknowledge that your personal information may be processed outside your country of residence. We take reasonable steps to protect your personal information regardless of where it is processed. Your statutory rights under consumer protection laws applicable in your jurisdiction are not affected by these terms. Precedence of separately signed agreements
Where you have entered into a separately signed written agreement with Tjantek including but not limited to a consulting agreement, statement of work, licensing agreement, or other formal contract, that agreement prevails over these Terms and Conditions to the extent of any inconsistency for matters it specifically addresses. These Terms and Conditions continue to apply in full to all matters not addressed by that agreement, and the two documents are to be read together as the complete agreement between the parties. No separately signed agreement excludes or limits any right you may have under the Australian Consumer Law that cannot be excluded or modified by agreement.

Currency and taxes
Prices displayed on this website are shown in the currency presented at the time of browsing or checkout, which may vary based on your location, browser settings, or the display settings of our storefront. Where prices are displayed in a currency other than Australian dollars, the Australian dollar price is the base price and governs in the event of any dispute or discrepancy. You are responsible for any local taxes, duties, bank fees, currency conversion costs, or other charges arising from transactions processed in a currency other than your local currency, except to the extent such responsibility cannot lawfully be imposed on you.
